Weicks was arrested by Las Vegas Metropolitan Police Department Officers on October 30, 2004 near the intersection of Las Vegas Blvd. and St. Louis Streets. Officers recovered a loaded 38 caliber revolver from his vehicle. Weicks claimed to be carrying the firearm to protect the minor. Under federal law he was prohibited from carrying the firearm due to earlier convictions.

Mario Weicks was convicted by a jury in March 2006 of two counts of Transportation of a Minor for Prostitution, two counts of Travel for Illicit Sexual Conduct, one count of Felon in Possession of a Firearm, and one count of a Crime of Violence. He was sentenced to 35 years in federal prison and 10 years of supervised release.
