Harry Franklin, also known as “Streets” and “Uncle Stacks,” 27, of the Bronx, N.Y., pleaded guilty on October 26, 2011 before United States Magistrate Judge Holly B. Fitzsimmons in Bridgeport, CT to one count of transportation of an individual with intent to engage in criminal sexual activity. The charge stems from Franklin’s involvement in an interstate prostitution enterprise that included the sex trafficking of two minor victims. According to court documents and statements made in court, Franklin facilitated the transportation of a woman and also a girl, who was 14-years-old at the time, from New York to Connecticut so that they could work in a prostitution business that Theodore Briggs was running out of an apartment in Norwalk, Conn. In pleading guilty, Franklin admitted that, in November and December 2010, he and others transported the woman from Connecticut to New York to engage in prostitution. He also admitted that he facilitated the transportation of the minor victim across state lines to engage in commercial sex acts. On October 25, 2011, Theodore Briggs, also known as “PeeJaye,” pleaded guilty to one count of transportation of an individual under the age of 18 with intent to engage in criminal sexual activity.

Oakdale, California, United States, 2011

United States US

An Oakdale woman has been charged with soliciting or inducing an individual to practice prostitution and engaging in the sex trafficking of an individual. The trafficker met the victim while substitute teaching at a program for young adults with disabilities and offered the victim the opportunity to earn extra money by giving messages at the traffickers’ home. She made arrangements to pick up the victim in the school’s parking lot and on April 22 drove the victim to her apartment. Once there the victim was told she could make money by giving massages and if she wanted to earn extra money she could provide sexual services. The trafficker then asked the victim to pose for photos which the trafficker later posted on a website along with the victim’s website. The trafficker would take the call and make the appointments. When a customer came to the apartment the trafficker took him the bedroom to give him a massage. The victim felt uncomfortable but could not leave as she didn’t have a ride from the apartment. She didn’t engage in any messages or sexual activity with the customer, however, she continued to receive phone calls from men wanting to receive messages and/or sexual services after she left the apartment. When interviewed by the police, the trafficker denied taking any photos of the victim, however, she later confessed to taking photos of the victim in lingerie and posting on the website. The police were able to retrieve seven images from the phone which she used to take the photos with. For the charges set against her the trafficker could face a maximum of 15 years in prison and $40,000 in fines for each count.

James Mozie, 34, was found guilty by a federal jury on December 20, 2011 of all charges against him in United States v. James Mozie. After a 5-day trial, the jury found defendant Mozie guilty of all ten counts in the indictment, including sex trafficking of minors and conspiracy to commit sex trafficking of minors. Mozie was also convicted of production of child pornography. At trial, seven different victims, many them runaways at the time they met Mozie, testified that they worked or were recruited to work as prostitutes at Mozie’s residence, which he advertised as “The Boom Boom Room.” According to the trial evidence, The Boom Boom Room, also known as Lot 29, operated for more than a year as a house of prostitution. Mozie advertised the business through the use of mass text messages to his contacts letting people know about the activities at the house each night. When customers arrived, they paid a cover charge to the security guard working the front door. The victims, many of them minors, worked in the house dancing for tips and engaging in sexual activity with male customers for money. Seven victims, all minors when the offenses occurred, testified that when they first arrived at the residence, Mozie had them complete an application asking for information such as name and stage name, date of birth, and specifying what sexual acts they were willing to perform. All of the minor victims testified that they provided their correct dates of birth to Mozie, who advised them not to tell customers that they were underage. Several of the minor victims testified that before working as a prostitute for Mozie, he required them to have sex with him as part of their “orientation," which he explained was his way of “testing the merchandise.” They also testified that Mozie would take sexually explicit images of them, which he attached to the text messages advertising the brothel. Co-defendant Laschell “Shelly” Harris pled guilty to one count of sex trafficking of a minor and was sentenced on November 16, 2011 to 13 years in prison. Co-defendant Willie David Rice pled guilty to one count of being a felon in possession of a firearm and was sentenced to four years in prison.

Members of a prostitution ring are charged with bringing Asian women into the Bay Area from Taiwan and China and forcing them into prostitution. Investigations began approximately a year before the arrests after neighborhood complaints about suspected prostitution activities in a home. The investigation revealed the home to be part of a chain of brothels. Law enforcement estimates that the chain had brought dozens of women into the country. Arrests were made in 10 locations around the Bay Area. Eight people were arrested, and ten women were brought into protective custody. The suspects were charged with conspiracy, pimping, pandering and human trafficking. They were all charged in the Alameda County Superior Court. “The suspects could face federal charges in addition to the local charges because federal agencies were part of the investigation.” (SF Examiner)

Mahendar "Mike" Singh, 40, and his wife, Helen Jean Singh (née Kearney), 22, are accused in an indictment, filed Dec. 1, 2011 of conspiring to traffic teenage females to provide sex acts to customers in exchange for money and other things of value. Mahendar Singh was arraigned Tuesday and pleaded not guilty before U.S. Magistrate Judge Laurel Beeler in Oakland. Helen Jean Singh's arraignment is set for Dec. 8., 2011 According to the indictment, the defendants recruited teenagers by promising them money, drugs and a "family-like environment." According to court documents, the defendants advertised their prostitution enterprise, which operated in Sacramento County and multiple Bay Area counties, over the Internet. An affidavit filed in the case alleges the defendants used an Internet website to advertise their victims and employed cell phones and text-messaging to make arrangements with customers. That affidavit states the defendants were arrested Aug. 20, 2011 after the South San Francisco Police Department responded to a motel near the San Francisco airport and found Mahendar Singh with a 19-year-old and two 16-year-olds.

An April 18, 2011 federal indictment says that Hitesh Vinod Patel, age 27, and his father, Vinod N. Patel, age 60, acting on behalf of Gayatri Investments LLC, helped and allowed members and associates of a criminal enterprise to rent rooms for prostitution at the Travelodge hotel on North Coast Highway in Oceanside. According to the indictment, the Patels arranged to have the participants housed in specific areas and rooms within the hotel so that they were segregated from legitimate customers. According to the indictment, the Patels charged --- and the defendants paid higher room rates --- in exchange for permitting the prostitution activities to be conducted at the Travelodge. The Patels are also accused of warning members and associates of the enterprise about law enforcement activity or inquiries. The operation was run by the Oceanside Crips gang, which included three different gang "sets," authorities said. The sets -- the Insane Crip Gang; Deep Valley Crips; and Crook, Mob, Gangsters -- who have been rivals in the past, worked together to run the prostitution operation, according to U.S. Attorney Laura E. Duffy. Six others, all women, were charged as associates of the criminal enterprise. The indictment targets not only pimps, but also women known as "bottoms," who federal prosecutors said are the most senior and trusted prostitutes, who help recruit and rein in the junior girls. U.S. Atttorney Laura E. Duffy said prostitutes caught up in the operation were often "traded like property" and beaten by their pimps if they did not do as they were told. Michael Carney, Acting Special Agent in Charge for ICE Homeland Security Investigations in San Diego, said the victims and the gang members were primarily U.S. citizens. An indictment is not evidence the defendants are guilty of the crimes charged. The defendants are presumed by the law to be innocent of the charges until the Government proves guilt beyond a reasonable doubt.

Samuel Martinez Gonzalez, 26, of Santa Ana, Calif., was charged in a criminal complaint filed August 15, 2011 in U.S. District Court with transporting minors with intent to engage in criminal sexual activity. According to the affidavit in support of the criminal complaint, one of the teens told investigators that Martinez invited them to go to California to "go to the beach." After arriving in California, the affidavit describes how the defendant took the girls shopping for “hoochie” dresses and high heels for their "job." The affidavit alleges that, in addition to the three Texas teens, Martinez had a fourth minor in his custody who was already working for him as a prostitute. At the time of his arrest, Martinez was accompanied by three females, including one of the teenage girls from Texas. The affidavit states that approximately one hour later, HSI agents and officers from the Orange Police Department located the two other missing teens in a motel room in Orange, California. According to the court document, the girls - who are 15 and 16 years old - told agents they were relieved they had been rescued and looked forward to being reunited with their families. During the probe, investigators found receipts in Gonzalez’s wallet for condoms and empty boxes of condoms in the motel room. Investigators also picked up a call to his cell phone from someone who wanted to arrange sexual services.

Hsien-Hsien “Jacqueline” Liu, 64, of Taiwan, residing in Overland Park, Kan., waived her right to a grand jury and pleaded guilty on November 18, 2011 before U.S. District Judge Greg Kays to the charge of fraud in foreign labor contracting for fraudulently obtaining two Filipino servants for her residence. By pleading guilty, Liu admitted that she fraudulently entered into employment contracts with two Filipino housekeepers, whom Liu then brought to the United States to work for her on B-1 visas. Liu paid them significantly less than the contractual amount and forced them to work excessive hours. In November 2010, Liu recruited and solicited a female citizen of Manila, Phillippines (identified in the plea agreement as Female Victim #1) to come to the United States to work as a housekeeper for her residence. Liu sent a signed contract via both Federal Express and fax from Kansas City, Mo., to Manila, which contained fraudulent terms of employment. The employment contract, which was used to obtain a B-1 visa for the victim, required that she be paid $1,240 per month to work 40 hours a week, eight hours a day. It only required her to be present in the residence during work hours. Liu admitted that she did not intend to comply with these terms. From March 6, 2011 to August 2011, contrary to the terms of the contract, Liu only paid the victim $450 a month, increased her work hours to 16-18 hours per day, and required that she work on the weekends and holidays. Liu had surveillance cameras installed inside the residence to monitor the victim and did not allow her to leave the residence without supervision or permission. The government’s investigation uncovered evidence that Liu had earlier engaged in the same conduct with another employee. Although the original federal criminal complaint charged Liu with conduct related to Female Victim #1, the affidavit filed in support of that complaint referred to a second victim. As part of the plea agreement, Liu is required to accept responsibility for the prior victim (identified in the plea agreement as Female Victim #2), also a woman from the Philippines, whom Liu employed in 2009-2010. Liu is the Director General of the Taipei Economic and Cultural Office located in Kansas City, Mo. The Taipei Economic and Cultural Office (TECO) is one of 13 offices responsible for maintaining close unofficial relations between the people of the United States and the people of Taiwan. They are generally the equivalent of a consulate of a foreign government, but the United States does not recognize Taiwan as a sovereign state.

Original source translated using googletranslate.com: 51 workers were released from their posts working as railway maintenance workers on the stretch of track that runs through the State Park of Serra do Mar between Bot and Santos. The workers were urgently employed, to fill a personnel gap, by a subcontractor of the overall rail company. Most of the victims were recruited from Santo Amaro (Bahia) with false promises – they were initially promised pay of $1,000 with a formal contract. They were promised a schedule of 22 days of work, followed by 8 days of rest. However, after more than two months, some workers had only received $680. The workers’ documents were retained, and their freedom was restricted. Dissatisfaction among workers increased and some managed to leave and return to Bahia. Others were transferred to accommodation in Serra do Mar, where inspectors became aware that the workers were being held as slaves. The accommodation consisted of isolated containers in the woods where workers were forced to sleep on the floor – many reported feeling cold and hungry. Before a kitchen was developed, they often received sour food from another accommodation. There were also limited bathroom facilities and hot water. Work began at 7am for 17 hours a day, 7 days a week. One worker said: “I ask for time off and said, ‘If you want, take. But outside the housing.’ I had to stay outside the housing. Not enough to eat. The only option was to continue working.’ The released workers recalled times when they had to replace de-railed cars back onto the tracks during the night (between evening and the following morning) – it took great physical effort, but they were given no breaks or food. Physical assaults were witnessed, and threats were also recorded regarding machetes and firearms.

Omelyan Botsvynyuk, 52, and Stepan Botsvynyuk, 36, were convicted October 12, 2011 of conspiracy to violate the Racketeer Influenced and Corrupt Organizations (RICO) Act in connection with a human trafficking scheme. Omelyan was also convicted of one count of extortion. From the fall of 2000 through the spring of 2007, the brothers conspired to engage in a pattern of racketeering activity by operating a human trafficking organization which smuggled young Ukrainian immigrants into the United States and then forced them to work for the brothers with little or no pay. The defendants promised the victims they would earn $500 per month with free room and board by working for the Botsvynyuk organization. Once the workers were smuggled into the United States, the brothers confiscated the immigration documents, then put the victims to work on cleaning crews in retail stores, private homes, and office buildings without paying them. The brothers used physical force, threats of force, sexual assault, and debt bondage to keep the victims in involuntary servitude. The brothers also threatened violence to the workers’ families who still residing in Ukraine. One female worker was brutally raped on several occasions by Omelyan. Prosecutors described the defendants as the "enforcers" of the enterprise in America, while brothers in the Ukraine served as recruiters. The recruiting was easy, given the lack of economic opportunity, they said. Omelyan Botsvynyuk was acquitted of similar charges at a trial in the Ukraine. The Botsvynyuks housed the victims in deplorable conditions and insisted they work for years until they pay off smuggling debts of $10,000 to $50,000, according to the indictment filed last year. The workers were moved frequently throughout the mid-Atlantic, where they said they often spent 16-hour days cleaning stores, offices and supermarkets. Some escaped despite the threats, prosecutors said. Authorities have said the retail stores were unaware of the situation, because they hired cleaning crews through contractors."I think every business should know who's working for them, but this is a common practice in all large businesses, they use subcontractors to hire workers," said Asst. U.S. Atty General Daniel A. Velez. Velez said he hoped the verdict would lead to more prosecutions of human-trafficking cases in the United States. The Botsvynyuk crews cleaned WalMart, Target, Kmart, Safeway, and other retail stores, along with homes and offices in Pennsylvania, Maryland, Delaware, New York and New Jersey. Juror Joe Higgins, a Teamsters Union trucker from Northeast Philadelphia, said: "They (stores) should check into what kind of contractors they're using to clean their stores. Do a little bit of digging, and make sure they're not using illegal aliens," said Higgins, 53. "Just because it's cheapest, it's not (always) right." The two defendants were indicted with three other brothers: Mykhaylo and Dmytro Botsvynyuk are awaiting extradition from Canada; Yaroslav Botsvynyuk is reportedly dead.

Andrew Fakhoury, 23, of Yonkers, N.Y. Prosecutors said that Fakhoury began forcing young women into prostitution in New York before moving his operation to Rhode Island in October of 2008 to take advantage of a loophole in state law that allowed indoor prostitution, until it was banned in 2009. Fakhoury eventually moved into an apartment in Providence’s Elmhurst section with one of those women and advertised her on Craigslist. So far, four victims have come to light; the youngest was 16 years old, and the oldest was 19. Two of the victims were from Yonkers, one was from upstate, and the fourth was from out of state. All were described as middle class kids with good grades – attractive yet emotionally vulnerable. One victim was promised a job as a waitress in Rhode Island on the beach. Using drugs and abusing the women, Fakhoury and his alleged cohort, Joseph Defeis, celebrated the thug life in several music videos posted on YouTube last year. Fakhoury called himself “Kash” and Defeis was “Jemz,” rapping in videos of them cruising around Providence in a black SUV, flashing fistfuls of $100 bills, and bragging that they were gangsters. With sunglasses perched on his nose and a large crucifix swinging from his neck, Fakhoury bragged: “Tell my lawyer, just eat the case.” A woman gyrated around a stripper pole in another video, as Fakhoury and Defeis rapped: “I keep a couple hos from around my way.” Providence police said the men beat the girls, kept close tabs on their cell phone calls, and treated them like merchandise.
